Terms of Service

By creating an account, purchasing a membership, or otherwise using Project Spartan, you agree to these Terms of Service. If you do not agree, do not use the service. These terms form a binding agreement between you and Project Spartan.

Project Spartan provides personalized coaching, training programs, nutrition guidance, and related educational content delivered by Kenneth Nyagumbo and any additional coaches engaged by Project Spartan. Services are educational and coaching-based; they are not medical advice, diagnosis, or treatment.

Membership tiers, features, and pricing are described on our pricing page and may be updated from time to time. The tier you select determines the specific services included in your engagement.

Subscriptions are billed in advance at the interval shown at checkout. All charges are processed securely by Stripe. You are responsible for keeping your payment information current. Current memberships are Essentials at $39/month or $390/year, Coaching at $199/month, and Elite at $499/month.

Essentials includes a 7-day free trial: $0 due today, then $39/month automatically once the trial ends, unless you cancel before it does. Your first paid charge falls on day 7 of the trial. Cancel any time during the trial from Settings → Membership and you will not be charged — there is no cancellation fee.

Subscriptions renew automatically at the end of each billing period at the then-current rate for your tier until cancelled. We will attempt to notify you in advance of any price change.

If a renewal payment fails, nothing is deleted and access is not cut off immediately. Your membership stays active for a 7-day recovery period while Stripe retries the payment, and we will let you know so you can update your card in the billing portal. If the payment is still unresolved after 7 days, membership access is suspended — your account, program history and training data are preserved, and access is restored automatically once payment succeeds.

You can cancel any membership at any time from Settings → Membership, which opens your secure billing portal. Cancelling stops the next renewal. It does not end the period you have already paid for — your membership and its benefits stay available until that period's scheduled end date. No prorated refund is issued simply because you cancel mid-cycle.

Essentials ($39/month), Coaching ($199/month) and Elite ($499/month) renew monthly. Cancel any time before your next billing date to prevent the next renewal; the current paid month remains active through its scheduled end date.

Annual Essentials ($390/year) renews yearly. Cancelling prevents the next annual renewal and does not automatically refund the unused portion of the current term. Annual Essentials subscriptions are generally non-refundable after the applicable initial cancellation period, except where a refund or cancellation right is required by applicable law.

Coaching and Elite include a 48-hour courtesy refund window after your initial purchase, provided no coaching service or session has yet been delivered. After that window the current billing period is generally non-refundable, except where required by applicable law or where we determine a refund is appropriate due to an error or exceptional circumstance. Cancelling still prevents future renewals, and unused time is not automatically prorated.

Cancelling an ordinary membership does not trigger a prorated refund. You keep full access for the remainder of the period you have already paid for, and unused time is not automatically refunded or credited.

Nothing in this policy limits any cancellation, refund, or other consumer rights that cannot lawfully be waived.

You are responsible for how you apply the coaching, programming, and information provided through Project Spartan. Results depend on effort, consistency, genetics, medical status, and other factors we cannot control. Training results cannot be guaranteed.

Project Spartan is educational and coaching-based and is not medical advice. Members are responsible for obtaining medical clearance from a qualified healthcare provider before beginning any exercise or nutrition program, particularly if you have or suspect a medical condition, are pregnant, or are recovering from injury.

Exercise involves inherent risk, including risk of injury or aggravation of pre-existing conditions. By using Project Spartan, you knowingly and voluntarily assume these risks. Stop any activity that causes pain, dizziness, or discomfort and seek medical attention.

To the fullest extent permitted by law, Project Spartan and its coaches, employees, and contractors will not be liable for indirect, incidental, special, or consequential damages arising out of or in connection with the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

Nothing in these Terms limits liability or rights that cannot lawfully be limited or waived under applicable law.

All programming, written content, videos, methodology, and branding on Project Spartan are owned by Project Spartan or its licensors. You receive a personal, non-transferable license to use materials for your own training during your membership. You may not resell, redistribute, or publish Project Spartan content without written permission.

Members are expected to communicate with coaches and other members respectfully. Harassment, discrimination, and abusive behavior are grounds for termination without refund.

We may suspend or terminate your access if you breach these terms, misuse the service, or engage in conduct that harms other members or coaches. You may terminate your account at any time by cancelling your subscription and requesting deletion.

These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Boston, Massachusetts, unless required otherwise by law.
